User-Generated Content
Providing VacationistUSA permission to use your Content is completely voluntary. It is standard practice for us to use Content with the creator’s permission and/or attribution. We are constantly searching for and acquiring many different types of Content from a variety of sources. We are currently looking for genuine, authentic Content that capture the travel experience.
Content
You may submit, upload, or otherwise make available images, text, video, or other content (“Content”) to VacationistUSA and its travel partners, which may be made available to the public. Upon request, VacationistUSA will provide author attribution via username when using your Content. You must be at least eighteen years old to submit Content. You may not submit any Content that is harassing, defamatory, threatening, violent, bigoted, hateful, vulgar, obscene, or otherwise offensive or that harms or may be reasonably expected to harm any person or entity.
License
VacationistUSA does not claim copyright in or ownership of your Content. You grant to VacationistUSA and its travel partners (clients of VacationistUSA) a non-exclusive, royalty-free, worldwide license under all copyrights, trademark rights, publicity and privacy rights, and any other intellectual property rights to reproduce, distribute, publish, display, perform, make available, index, modify, adapt, translate, create derivative works from, and otherwise use and exploit your content, in whole or in part, in any media now known or hereafter discovered, with or without attribution, without further permission from or notice or payment to you or any other person or entity, for any purpose, including in connection with VacationistUSA and its travel partner purposes and on third-party sites.
Warranty
By accepting these Terms & conditions you represent that your Content is your original work, and warrant that your Content conforms to these Terms & Conditions and that you own or have the necessary rights and permissions, without the need for any license from or payment to any other person or entity, to grant the license above.
Indemnity and Limitation of Liability
You agree to indemnify and hold VacationistUSA (and its employees, agents, travel partners, clients, and representatives) harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) made against us by any third party arising out of or in connection with our use of your Content.
